ESOS Phase 3 additional requirements and extension deadline
The ESOS Phase 3 deadline has been extended until the 5th June 2024 (previously 5th December 2023) to allow participants reasonable time to meet the new ESOS assessment requirements.
To summarise the new requirements for inclusion within the ESOS assessment are:
Submission of additional data for confirmation of compliance notification
Standard Industrial Classification (SIC) code
Reason for qualification in ESOS based on employee numbers, turnover, balance sheet, inclusion in corporate group
All undertaking company registration number covered by the group
Inclusion of appropriate energy intensity metric in ESOS reports, for example:
kWh/m2 for building (using Gross Internal Area or GIA)
kWh/miles travelled for passenger transport or kWh/tonne mile for freight
kWh/unit output for industrial process (tonne, litre, unit)
kWh/£ of total energy intensity in terms of total turnover
A reduction in the de minimis exemption to 5% requiring participants’ Significant Energy Consumption to now cover at least 95% of the Total Energy Consumption.
Provision of more information on next steps for implementing energy improvement recommendations including:
Costs, benefits and payback period
If not being implemented immediately the intervention point
Energy saving opportunities achieved in kWh during the Phase 3:
Separate organisations if part of group
Use category, whether in buildings, transport or industrial process
Type of opportunity, for example energy management, behaviour change, capital investment
Phase 1 and 2 ESOS historic information:
kWh energy consumption broken down into use category
Significant Energy Consumption broken down into use category
Total savings in kWh from energy savings opportunities, and broken down into use category
Target or action plan to be reported on annually which participants will have to complete after the Phase 3 compliance deadline

Important dates to remember
Large organisations now have until the 5th June 2024 to submit their ESOS Phase 3 Assessment, and you must first notify ‘Scheme Administrator’ to avoid possible enforcement actions.
Failure to notify or delays in submitting your ESOS Assessments could result in fines of up to £50,000 - along with daily penalties of £500 for every day your company is non-compliant.
